1. Acceptance of Terms

By accessing or using QuipForm ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access or use QuipForm.

2. Description of Service

QuipForm is a web-based form builder that allows you to create, publish, and manage online forms. The Service includes a free tier and paid subscription plans with additional features.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use of your account.

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. Free Plan & Watermark

The free plan includes unlimited forms and submissions. All forms on the free plan display a "Built with QuipForm" watermark. This watermark may not be removed, hidden, or obscured without upgrading to a paid plan.

5. Paid Subscriptions

Paid plans are billed through our merchant of record, Lemon Squeezy. By subscribing, you authorize recurring charges at the selected billing interval (monthly or yearly). You may cancel at any time, and access will continue until the end of your current billing period.

Refunds are handled on a case-by-case basis. Contact hello@quipform.com for refund requests.

6. Acceptable Use

You agree not to use QuipForm to:

• Collect data in violation of applicable privacy laws
• Send spam, phishing, or unsolicited communications
• Host or distribute malicious content, malware, or illegal material
• Impersonate any person or entity
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Interfere with or disrupt the integrity or performance of the Service
• Circumvent or disable any security features of the Service

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. Your Content

You retain all rights to the forms you create and the data you collect through QuipForm. By using the Service, you grant us a limited license to host, store, and display your content solely for the purpose of providing the Service.

You are solely responsible for the content of your forms and for ensuring that your data collection practices comply with applicable laws, including GDPR and CCPA.

8. Intellectual Property

The QuipForm name, logo, and all related product and service names, designs, and slogans are trademarks of QuipForm. You may not use these marks without our prior written permission. The Service and its original content (excluding user content) remain the exclusive property of QuipForm.

9. Limitation of Liability

To the maximum extent permitted by law, QuipForm shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may terminate or suspend your account at any time for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will survive.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or in-app notification. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which QuipForm operates, without regard to conflict of law principles.
